¿What are a prenuptial agreement?
Prenuptial agreements are a contract by which future spouses or those already married can regulate the administration and disposal of their present and future assets. Their purpose is to provide clarity, legal certainty, and asset protection, in accordance with Costa Rican law.
Far from reflecting a lack of trust, a prenuptial agreement is a responsible planning tool that allows a couple to make informed decisions regarding their assets. It is especially advisable when there are pre-existing assets, family businesses, investments, inheritances, or children from previous relationships.
Requirements and validity
In accordance with the Article 37 of the Family Code, Prenuptial agreements must be executed as a public deed and registered in the Public Registry to be valid. They can be granted before the marriage or during its existence and can cover present and future assets.
