When are marital assets generated?
Community property is generated, in general terms, during the duration of the marriage, when the acquired assets or rights meet the requirements established by Costa Rican legislation to integrate the community property. Its determination does not depend only on the date of acquisition, but also on its origin and the particular circumstances of each case. Therefore, it is advisable to carry out a legal analysis before distributing it in a divorce process.
